1. What smokyfi is
smokyfi is a marketplace. Independent lounges, smoke shops and caterers (vendors) list hookah rentals, catering, delivery and pickup services. smokyfi provides the marketplace, the booking flow, payment processing and the agreement-signing tools. smokyfi is not a party to the rental itself, does not own the equipment, and does not sell tobacco. Where tobacco is included in a service, it is sold by the vendor under the vendor's own tobacco retail permit.
2. Eligibility and accounts
- You must be 21 or older to create an account and book. Misrepresenting your age is unlawful and grounds for immediate account closure.
- One account per person. Accounts are personal and cannot be transferred or shared.
- You are responsible for the activity on your account and for keeping your login details secure.
- Some services are restricted in areas with local bans on flavored tobacco or hookah services. smokyfi enforces those restrictions automatically, and a booking that cannot legally be served will be blocked or cancelled with a full refund.
3. Bookings and payments
- A booking is confirmed when payment succeeds and you receive a confirmation in the app and by email.
- Prices, taxes and any deposit are shown before you confirm. State sales tax is calculated at checkout for the place where the service happens. Deposits are holds, not charges, and are never taxed.
- Payments are processed by our payment provider. By booking, you authorize the charges and deposit holds described at checkout.
- Vendors are paid after the service is complete. Rental deposit holds follow the Rental Terms and Policy.
- Cancellations and refunds follow Section 8 of the Rental Terms and Policy for rentals, and the terms shown on the listing for catering and other services.
4. Customer responsibilities
- Present valid photo ID proving age 21+ at handover and delivery.
- Use equipment lawfully and safely, only in ventilated areas, and never leave lit coals unattended.
- Never provide equipment or tobacco to anyone under 21, and never use the equipment for any illegal substance or purpose.
- Return equipment on time and in the condition described in the Rental Terms and Policy.
- Leave honest reviews based on your actual experience.
5. Vendor responsibilities
- Vendors are independent businesses, not employees, agents or partners of smokyfi.
- Vendors must hold every permit and license their jurisdiction requires, including tobacco retail permits, and must comply with all tobacco, tax and delivery laws that apply to their bookings.
- Vendors must verify customer age at handover and delivery, supply equipment that is clean, sanitized, safe and as described, document handovers with in-app photos, and follow the claim timelines in the Rental Terms and Policy.
- Cleaning and sanitizing between rentals is the vendor's duty and cost. A cleaning fee may never be charged to a customer.
- smokyfi charges vendors a platform fee of 10% of each completed booking. There are no listing or monthly fees.
6. Risks, waiver and liability
Hookah use carries real risks: nicotine addiction, exposure to carcinogens and carbon monoxide, and burns or fire from charcoal. At booking, every customer signs a platform waiver covering assumption of risk, release and indemnification, and that waiver is part of these terms by reference. To the fullest extent allowed by law, smokyfi is not liable for the conduct, premises or equipment of independent vendors or customers, or for indirect or consequential damages arising from a booking. Nothing in these terms waives liability that cannot legally be waived, including liability for gross negligence or intentional misconduct.
7. Acceptable use
You may not use smokyfi to break the law, to buy for or supply anyone under 21, to harass other users, to post false reviews, to scrape or copy listings, or to interfere with the platform. We may suspend or close accounts that violate these terms, and vendors may be removed for repeated cancellations, failed age checks or unclean equipment.
8. Disputes and governing law
Booking disputes, including damage claims, follow the process in the Rental Terms and Policy: platform review first, in good faith. These terms are governed by the laws of the State of Florida. If any part of these terms is held unenforceable, the rest continues in full effect.
9. Electronic signatures and records
Transactions on smokyfi are conducted electronically under the federal E-SIGN Act and Florida's Uniform Electronic Transaction Act. Your typed name or click-to-sign, with its timestamp and IP address, is your binding signature on rental agreements and waivers, and you consent to receive your copies electronically.
10. Changes to these terms
We may update these terms. Material changes apply to bookings made after the update takes effect. Continuing to use smokyfi after a change means you accept the updated terms for future bookings.
